These Terms of Use govern your use of ParkMana. Please read them carefully. By downloading, accessing or using ParkMana, you agree to be bound by them.
1. Agreement to these Terms
These Terms of Use (“Terms”) form a legally binding agreement between you and the independent developer of ParkMana, an individual based in Malaysia (“ParkMana”, “we”, “us” or “our”) for the use of the ParkMana Android app, the ParkMana web app, the website at parkmana.app and related services (together, the “Services”).
If you do not agree to these Terms, do not use the Services. Our Privacy Policy explains how we handle personal data and forms part of these Terms.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, or under the age of majority where you live, you may use the Services only with the consent of a parent or guardian, who agrees to these Terms on your behalf. You must not use the Services if you are barred from doing so under applicable law.
3. The Services
ParkMana helps drivers find parking, compare and estimate parking charges, remember where they parked, receive reminders, and share parking information with other drivers. Some features are available to guests, some require an account, and some are available only to ParkMana Premium members.
We continually improve the Services and may add, change, suspend or remove features at any time. We will give reasonable notice of changes that materially reduce what you have paid for. Some features may be labelled as new, beta or experimental and may not work as reliably as others.
The Services may be unavailable from time to time for maintenance, because of a failure of a third-party service such as Google Maps, or for reasons beyond our control. We do not guarantee that the Services will be available at all times or free of errors.
4. Parking information and fare estimates
Parking information in ParkMana comes from operators’ published rates, public sources, Google Maps and other users. It may be incomplete, out of date or wrong. In particular:
- Fares shown are estimates only. They are calculated from the rate information available to us and may not reflect current prices, public holiday or event rates, grace periods, validation, lost-ticket charges, taxes or other charges.
- A car park shown as free, open, available or “Verified rates” is not a promise that it is free, open, has space, or that you are permitted to park there.
- Auto-detect parking, pillar-sign reading, locations and walking directions are approximate and may be inaccurate.
- ParkMana is not a parking payment service and does not issue, pay or settle parking tickets, compounds or summonses.
You are responsible for checking the rates, opening hours, access restrictions and rules posted at the car park and for complying with them. To the extent permitted by law, we are not responsible for parking charges, fines, compounds, summonses, clamping, towing or other consequences arising from reliance on information in the Services.
5. Safe and lawful use
Do not use ParkMana while driving or in any way that distracts you from the road. Set up your search, reminders and directions before you drive, or have a passenger operate the app. Always obey traffic laws, road signs and the instructions of car park operators and the authorities. Walking directions may route you along roads or paths that are unsuitable; use your own judgement.
6. Your account
- You must provide accurate information when you create an account and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly if you believe your account has been used without your permission.
- Accounts are personal. You may not sell, transfer or share your account, or create accounts by automated means.
- You can delete your account at any time from Profile → Settings → Account & data.
7. ParkMana Premium
7.1 Subscription and billing
ParkMana Premium is a paid subscription that adds features described in the app, such as removing ads, higher daily search limits, automatic cloud backup of your parking history and custom reminders. Subscriptions are sold and billed by Google Play using the payment method in your Google account, and are also subject to the Google Play Terms of Service. The price, billing period and any applicable taxes are shown before you confirm your purchase.
7.2 Automatic renewal
Your subscription renews automatically at the end of each billing period at the then-current price unless you cancel it at least 24 hours before the end of the current period. You can cancel at any time in the Google Play Store under Payments & subscriptions → Subscriptions. After cancelling, Premium remains active until the end of the period you have paid for. Uninstalling the app does not cancel your subscription.
7.3 Price changes
We may change the price of Premium. Google Play will notify you of a price increase in advance, and where required, ask you to accept it before your subscription renews at the new price.
7.4 Refunds
Payments are processed by Google, and refund requests are handled under Google Play’s refund policies. Except where required by law, we do not provide refunds or credits for partial billing periods or unused features.
7.5 Premium earned through contributions
From time to time we may award Premium time for approved contributions, as described in the app. Earned Premium has no cash value, cannot be transferred or exchanged, and is added after any Premium you already have. We decide whether a contribution is approved, and we may change or end the programme at any time. Premium already earned will still be honoured. We may withdraw earned Premium obtained through false, duplicated or abusive contributions.
8. Content you submit
8.1 Your responsibility
You are responsible for the reviews, ratings, photos, rate information, corrections, suggested car parks, reports and other content you submit (“User Content”). By submitting User Content, you confirm that:
- it is accurate to the best of your knowledge, and based on your own experience;
- you own it or have all rights needed to submit it and grant the licence below;
- it does not infringe anyone’s intellectual property, privacy or other rights; and
- it complies with these Terms and applicable law.
8.2 Licence to ParkMana
You keep ownership of your User Content. You grant ParkMana a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to use, host, store, reproduce, modify (for example, to crop photos or correct formatting), publish, display and distribute your User Content in connection with operating, improving and promoting the Services. For rate information, corrections and suggested car parks that become part of our parking catalogue, this licence is perpetual and irrevocable. For reviews and photos, the licence ends when you delete them, except where they have been shared with others or retained as described in our Privacy Policy.
8.3 Content rules
User Content must not:
- be false, misleading, or deliberately incorrect, including fake reviews or rates;
- be offensive, abusive, hateful, threatening, harassing, obscene or discriminatory;
- show identifiable faces, vehicle number plates, receipts or other people’s personal information without their consent;
- contain advertising, spam, links to unrelated sites, or content written in exchange for payment or another benefit without disclosing it;
- be unlawful, or encourage illegal activity; or
- contain viruses or other harmful code.
8.4 Moderation
We are not obliged to monitor User Content, but we may review, edit, refuse, hide or remove any User Content at our discretion, including content reported by other users. Contributions are checked before they are published. You can report content that breaks these Terms using Report in the app.
9. Acceptable use
You must not, and must not help anyone else to:
- copy, scrape, harvest or extract data from the Services by automated means, or use the Services or their data to build a competing product or database;
- access our servers or APIs other than through the official ParkMana apps and website, or exceed or circumvent usage limits;
- reverse engineer, decompile, disassemble or modify the Services, except to the extent the law expressly permits this despite this restriction;
- interfere with or disrupt the Services, probe or test their vulnerability, or bypass security or authentication measures;
- impersonate any person, or misrepresent your connection with a person or organisation;
- submit false reports, or manipulate ratings, contributions or rewards;
- remove, obscure or alter any notices, logos or attributions in the Services, including those of Google and OpenStreetMap; or
- use the Services for any unlawful, harmful or fraudulent purpose.
10. Intellectual property
The Services, including the software, design, text, graphics, logos and the ParkMana parking catalogue, are owned by ParkMana or its licensors and are protected by copyright, trade mark and other laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the Services for your own non-commercial purposes. All rights not expressly granted are reserved. “ParkMana” and the ParkMana logo are our trade marks and may not be used without our written permission.
If you send us suggestions or feedback, we may use them without restriction or compensation to you.
If you believe content in the Services infringes your copyright, contact us with details of the work, where it appears, and your contact information, and we will respond promptly.
11. Third-party services
The Services rely on, and link to, services provided by third parties, which are subject to their own terms:
- Google Maps features and content are subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
- Premium is subject to the Google Play Terms of Service.
- Map data includes data © OpenStreetMap contributors, available under the Open Database Licence.
- Fuel prices are provided by data.gov.my under its open data terms.
- Check summonses opens the official MyBayar PDRM and MyJPJ services, which are operated by the relevant government agencies.
We do not control and are not responsible for third-party services, their content or their availability.
12. Advertising
The free tier of the Services is supported by advertising served by Google. Ads are provided by third parties, and we do not endorse the products or services advertised. Your dealings with advertisers are solely between you and them.
13. Disclaimer
To the maximum extent permitted by law, the Services and all information in them are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free, that parking information or fare estimates will be accurate, or that reminders and notifications will be delivered on time, as delivery depends on your device and its settings.
14. Limitation of liability
To the maximum extent permitted by law, ParkMana will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, or for parking charges, fines, compounds, summonses, clamping or towing costs, arising out of or in connection with the Services or these Terms, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for all claims arising out of or in connection with the Services or these Terms is limited to the greater of (a) the amount you paid us for Premium in the 12 months before the event giving rise to the claim, and (b) RM 100.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act 1999 where it applies to you.
15. Indemnity
To the extent permitted by law, you agree to indemnify ParkMana against claims, losses, liabilities and reasonable expenses, including legal fees, arising from your User Content, your breach of these Terms, or your violation of any law or the rights of a third party.
16. Suspension and termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, remove your User Content, or withdraw Premium earned through contributions, if you breach these Terms, if required by law, or if your use poses a risk to other users, third parties or the Services. Where reasonable, we will tell you why and give you an opportunity to respond. If we terminate a paid subscription without cause, we will refund the unused portion. Sections 4, 8.2, 10 and 13 to 19 survive termination.
17. Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows when they last changed. If we make a material change, we will notify you in the app or on this website at least 14 days before it takes effect, unless the change is required by law or to address an urgent security issue. If you continue to use the Services after the change takes effect, you accept the updated Terms. If you do not agree, you should stop using the Services and cancel any subscription.
18. Governing law and disputes
These Terms are governed by the laws of Malaysia. Before starting formal proceedings, please contact us so that we can try to resolve the matter informally. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts of Malaysia, without affecting any right you have as a consumer to bring a claim before the Tribunal for Consumer Claims Malaysia or in the courts of the place where you live.
19. General
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services.
- Severability. If any provision is found invalid or unenforceable, the rest of these Terms remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, provided your rights are not reduced.
- Events outside our control. We are not responsible for delay or failure caused by events beyond our reasonable control.
- Language. These Terms are also available in Bahasa Melayu. If there is any inconsistency, the English version prevails to the extent permitted by law.
